BOOKING CONDITIONS:

All bookings are made with Magic Tuscany acting as intermediates for the property owners and are subject to the following conditions:


Art. 1 BOOKING

A deposit of 40 % is required to secure a property. No contract with Magic Tuscany will be entered into until the Booking form and deposit have been received.
We reserve the right to refuse a booking without giving a reason. It is understood that this contract is valid from the acceptance of the booking to the end of your stay.

Art. 2 PAYMENT OF THE BALANCE

The balance must be paid at least 30 days before arrival in Tuscany. If the balance is not received by us we shall be entitled to cancel the booking without prejudice to our claim for cancellation charge and to retain the deposit. For bookings made within 30 days of the arrival date you will be required to pay the full cost of your stay at the time of booking.

Art. 3 CANCELLATION BY YOU

If you cancel all or any part of the booking, or the booking is cancelled by Magic Tuscany due to non-payment, we shall be entitled to the following percentage of the rental cost:

From Acceptance of booking, Up to 20 days prior to arrival date 40%
Less than 20 days before your arrival date 100 %
Any cancellation must be received by Magic Tuscany in writing.

Art. 4 CANCELLATION BY ‘FORCE MAJEURE’

Though Magic Tuscany makes every effort not to cancel any booking, it does occasionally happen
If your stay is not possible. Magic Tuscany will advise you by e-mail or by phone and offer to transfer you to a similar property. The difference in the cost of the new accommodation will be either payable by you if greater or reimbursed by Magic Tuscany if less. If this is not possible or you do not wish to be transferred Magic Tuscany will refund the amount paid by you in full.

Art. 5 NUMBER OF PERSONS

Only those persons listed on the BOOKING FORM may use the property. The number of people must not exceed the number of beds indicated in the property list. Additional guests may only be accommodated in the property with the permission of the owner of the property and if possible he may add additional beds. This is totally at the discretion of the owner. Should the owner find any violation to this clause it is totally at his discretion to ask you to leave the house without compensation.

Art. 6 EXTRAS

All extra are specified on the property listing and are either payable in local currency on arrival or during tour stay. Any extras will be itemised separately at the end of your stay.
If you wish to partake of any additional activities please give us as much notice as possible for these to be organised.

Art. 7 HOLIDAY PERIOD

Normal rental periods are from Saturday evening to Saturday morning. Check-in at 04.00 p.m. check-out at 10.00 a m. unless alternative arrangements. Some owners may be prepared to change these dates/times at additional costs. During low season booking short breaks and variations on normal booking periods may be available, Please Ask.

Art. 8 DEPOSIT

A deposit is due to most of the properties on arrival. This amount is determined by the owner and payment is required in local currency upon your arrival. The deposit covers the cost of any damage or breakage during your stay at the property. Judgement as to the condition of the property is left to the discretion of the owner. The deposit will be returned to your upon departure. Should the damage exceed the security deposit amount, you have to pay the additional charges on demand.


Art. 9 COMPLAINTS

Although Magic Tuscany always endeavours to describe the properties in full aiming to offer you a holiday to remember, we decline responsibility for any modifications made by the owners without our knowledge. We do not accept responsibility for the breakdown of essential services. Should you have any problem during your stay please do not hesitate to contact our staff at the numbers listed on your voucher. Complaints lodged at the end of the rental period will not be taken into consideration. Should you abandon the property without authorisation from the owner, you will lose all rights to compensation.


Art. 10 BEHAVIOUR

The person signing the booking form is responsible for the correct and decent behaviour of his party; this person must ensure that his party behave in a civilise manner. Should this point not be fulfilled according to civilised standards, the owner may ask the person and his party to leave the property without compensation.


Art. 11 JURISDITION

This contract is governed by the laws of Italy. Italian law have exclusive jurisdiction over any claims, quarrels or other matters in between the parties. The Court in Arezzo has exclusive jurisdiction over any claims. You will also be responsible for paying Magic Tuscany’s attorney’s fees.
